This Privacy Policy applies to all customers, site visitors, and users of our Services, including those accessing via third-party integrations like Facebook Messenger. Each customer is responsible for their own privacy practices when using our tools to create chatbots, and must ensure compliance with applicable laws.

We may update this Privacy Policy periodically to reflect changes in our Services or legal requirements. Changes are effective immediately upon posting the revised policy on our Site. Your continued use of the Services after changes indicates your acceptance. We will notify you of material changes via email or prominent notice on the Site.

We collect personal data you provide directly, data collected automatically, and data from third parties.

- Directly from you: Email address, account information (e.g., username), OAuth tokens from integrations like Google or Facebook (e.g., access/refresh tokens), chatbot configuration details (e.g., spreadsheet names, bot scripts), and any messages or queries submitted.

- Automatically: IP address, browser type/version, device information, usage logs (e.g., API access counts, interaction timestamps), and cookies/tracking data for analytics.

- From third parties: If integrated with Facebook Messenger, we may collect Facebook user ID, profile name, messages, and interaction data via Meta APIs, only with your consent and as necessary for chatbot functionality.

We do not collect sensitive data (e.g., health, financial) unless explicitly required for a custom bot feature, and only with consent.

We use your data to:

- Provide and improve our Services (e.g., process chatbot queries, generate responses via AI).

- Analyze usage to enhance functionality and user experience.

- Communicate with you (e.g., support, updates).

- Comply with legal obligations and prevent abuse.

For Facebook integrations, data is used solely to facilitate chatbot interactions, such as responding to user messages.

We share data only as necessary:

- With subprocessors for service delivery (e.g., Posthog (EU) for analytics: https://posthog.com/eu/).

- With OpenAI (https://openai.com) to process user messages and generate chatbot responses, under strict data processing agreements ensuring data is processed securely and not stored by OpenAI beyond the interaction.

- With Meta/Facebook for API integrations, as required for Messenger functionality.

- As required by law, or to protect rights/safety.

We do not sell your data.

We implement reasonable security measures, including encryption, access controls, and regular audits, to protect your data from unauthorized access, loss, or disclosure. However, no system is entirely secure, and we cannot guarantee absolute security.

We retain data only as long as necessary for the purposes described (e.g., account data while active, logs for 12 months). User messages processed via the OpenAI API or Facebook Messenger are not stored on our servers; they are processed ephemerally during the interaction. Upon deletion request or account closure, we delete data within 30 days, except where legally required to retain.

We comply with both the General Data Protection Regulation (GDPR) for EU/EEA residents and the California Consumer Privacy Act (CCPA) for California residents, ensuring you can exercise your rights under both frameworks consistently. Your rights include:

- GDPR: Access, correct, delete, restrict, or port data.

- CCPA: Know, delete, and opt-out of sales (we do not sell data).

To exercise rights, email support@influxify.io with verification. We respond within 30-45 days. For data deletion, use the same email; we will confirm and process promptly.

Data may be transferred to the US or other countries. We use Standard Contractual Clauses or equivalent safeguards for transfers outside the EEA.

Our Services are not for children under 13 (or 16 in some jurisdictions). We do not knowingly collect data from children; contact us if you believe we have.
